1. Acceptance of These Terms

These Terms of Use ("Terms") govern your use of the Aravae mobile application, website, and related services (together, the "Services"), provided by Aravae B.V. ("Aravae," "we," "us," or "our").

By creating an account, accessing, or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

You must be at least 18 years old to use Aravae.

2. What Aravae Provides

Aravae is an energy-aware productivity and planning companion. Features may include:

• task and priority management;
• an in-app calendar and planning tools;
• manually entered energy and wellbeing check-ins;
• reminders and push notifications;
• progress summaries;
• an AI-powered planning Assistant.

Aravae may use your voluntary inputs to organize tasks or suggest a pace for your day. Energy descriptions and predictions are estimates, not objective measurements or medical assessments.

3. Not Medical or Professional Advice

Aravae is not a medical, healthcare, mental-health, therapy, crisis-support, or diagnostic service. It does not diagnose, treat, prevent, or monitor any disease or health condition and does not replace qualified professional care.

The Services and AI-generated content are provided for general productivity and informational purposes. Do not rely on Aravae for medical, psychological, legal, financial, safety-critical, or emergency decisions. Always seek an appropriately qualified professional when needed.

If you believe you are experiencing a medical or mental-health emergency, contact local emergency services.

4. Accounts

You are responsible for providing accurate account information, keeping access to your account secure, and promptly notifying us of suspected unauthorized use. You may not impersonate another person, create an account for someone without permission, or use the Services if your access has previously been terminated for serious misuse.

5. Free and Paid Features

The free plan includes unrestricted access to Home, Calendar, Settings, and reminders, together with up to three Assistant messages per day.

Aravae Plus provides unlimited Assistant messages and any additional premium features displayed in the app at the time of purchase.

Feature availability may evolve. We will not materially reduce an active paid subscription without reasonable notice, except where necessary for security, law, or circumstances outside our reasonable control.

6. Subscription, Free Trial, and Billing

Aravae Plus is offered as an automatically renewing monthly subscription for €8.99 per month, subject to the price displayed in the App Store for your country.

Eligible new subscribers may receive a two-week free trial. Unless cancelled at least 24 hours before the trial ends, the subscription automatically converts to a paid monthly subscription. Payment is charged to your Apple account. The subscription automatically renews unless cancelled at least 24 hours before the end of the current billing period.

Apple manages payment, renewal, cancellation, billing issues, and applicable refunds under its terms. You can manage or cancel your subscription in your Apple account subscription settings. Deleting your Aravae account or the app does not automatically cancel your subscription.

Your Apple account may be charged for renewal within 24 hours before the end of the current subscription period.

Prices and trial eligibility may vary by region and may change. The App Store purchase screen shows the binding price and conditions before you confirm a purchase. Free trials are generally limited to one per eligible Apple account.

Where available, you may use "Restore Purchases" to restore an active subscription.

7. AI Assistant

Assistant responses are generated automatically and may be inaccurate, incomplete, outdated, or unsuitable. You remain responsible for reviewing responses and deciding whether to act on them.

Aravae does not guarantee any particular response, outcome, productivity improvement, or level of availability. Do not submit unlawful content or highly sensitive information that is unnecessary for planning.

"Unlimited" use is subject to reasonable technical, security, and anti-abuse limits. We may temporarily restrict excessive automated activity or misuse that threatens service stability or other users.

8. Acceptable Use

You must not:

• use the Services unlawfully, fraudulently, or to harm, threaten, harass, or exploit others;
• submit content that infringes another person's rights;
• attempt to gain unauthorized access to accounts, systems, or data;
• interfere with security, availability, or operation of the Services;
• use bots, scraping, automated prompts, or other methods that place an unreasonable load on the Services;
• reverse engineer, copy, modify, resell, or exploit the Services except where applicable law expressly permits it;
• bypass message limits, subscription controls, or other access restrictions;
• use AI output to facilitate illegal, harmful, deceptive, or abusive conduct.

We may restrict or suspend access where reasonably necessary to investigate misuse, protect users, comply with law, or maintain service security.

9. Your Content

You retain ownership of information and content you submit. You grant Aravae a limited, non-exclusive right to process that content only as necessary to provide, secure, and operate the Services and comply with law.

You confirm that you have the right to submit your content and that doing so does not violate law or another person's rights.

10. Aravae's Intellectual Property

The Services, including their design, software, branding, text, graphics, and original content, are owned by Aravae or its licensors and are protected by intellectual-property laws.

These Terms give you a personal, limited, non-exclusive, non-transferable, and revocable right to use the Services for their intended purpose. They do not transfer ownership of any Aravae intellectual property.

11. Availability and Changes

We aim to provide a reliable service but do not promise uninterrupted or error-free availability. Features may be updated, improved, suspended, or discontinued. Maintenance, security incidents, third-party services, internet availability, and events outside our control may affect the Services.

12. Third-Party Services

Aravae relies on third-party services, including Apple's App Store, subscription infrastructure, cloud services, push-notification services, and an AI service provider. Their separate terms and privacy practices may apply to their services.

Apple is not responsible for providing maintenance or support for Aravae except as required by law.

13. Suspension and Termination

You may stop using Aravae at any time and may request account deletion. We may suspend or terminate access if you materially or repeatedly violate these Terms, create a security risk, misuse the Services, or if continued access would violate law.

Termination does not automatically cancel an Apple subscription. You must cancel it through your Apple account settings.

14. Disclaimers

To the fullest extent permitted by law, the Services are provided "as is" and "as available." We do not guarantee that suggestions, predictions, notifications, AI responses, or other content will be accurate, complete, timely, or suitable for your individual needs.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

15. Limitation of Liability

To the fullest extent permitted by applicable law, Aravae is not liable for indirect, incidental, special, or consequential loss, loss of data, lost opportunities, or losses caused by reliance on AI-generated content, missed notifications, or service interruptions.

Our liability is not limited where doing so would be unlawful, including liability for intent, gross negligence, death or personal injury caused by negligence, or mandatory consumer protections.

16. Privacy

Our Privacy Policy explains how we process personal data and forms part of these Terms.

17. Governing Law and Consumer Rights

These Terms are governed by the laws of the Netherlands. If you are a consumer living elsewhere, you retain any mandatory protections provided by the law of your country of residence.

Disputes may be submitted to the competent courts of the Netherlands, without limiting any right you may have under mandatory consumer law to bring proceedings in your country of residence.

18. Changes to These Terms

We may update these Terms to reflect changes to the Services, law, security requirements, or business operations. We will provide reasonable notice of material changes where required. Continuing to use the Services after the effective date means the updated Terms apply.

19. Apple-Specific Terms

These Terms are between you and Aravae, not Apple. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the relevant provisions against you.

Aravae, not Apple, is responsible for the Services, support, and addressing claims relating to Aravae, subject to applicable law. Your use of the app must comply with the App Store Terms of Service and other applicable Apple usage rules.

These Terms supplement Apple's Licensed Application End User License Agreement ("Apple Standard EULA"), available at apple.com/legal/internet-services/itunes/dev/stdeula. If these Terms conflict with mandatory provisions of the Apple Standard EULA, those provisions apply to your use of the iOS app.
